Professional Experience
Mr. Haney practices in the areas of product liability litigation, construction law and litigation, real estate litigation and appellate law. His practice is principally focused on the defense of product liability claims against transportation companies and manufacturers, construction equipment manufacturers and industrial machine manufacturers. His construction litigation practice involves the representation of developers, contractors and design professionals. He has arbitration, trial and appellate experience in complex civil litigation in several areas, including products liability and warranty claims, construction defect disputes, public and private surety bond claims, acceleration and delay damage claims, partnership disputes, contract disputes, and foreclosures. Mr. Haney also frequently negotiates complex construction agreements for owners and contractors. Though Mr. Haney practices throughout the State of Florida, a significant percentage of his product liability practice involves cases venued in the Tampa (40 percent) and Miami-Dade (40 percent) metropolitan areas. His recent experience includes:
- Successful defense of national transportation service company against lawsuit alleging defective design of equipment and failure to warn.
- Successful defense at trial of national rental company against product liability claims.
- Frequent representation of product liability and construction litigation client's in alternative dispute resolution proceedings, including private and court-ordered arbitration hearings and mediation conferences.
- Negotiated very favorable pre-trial resolution of wrongful death action against farm equipment manufacturer for less than 20 percent of plaintiff’s demand at mediation.
- Successful defense at trial of luxury custom home builder against claim by purchaser for breach of contract alleging defective construction and excessive billing under cost-plus agreement for construction of model home.
- Successful litigation of claim on behalf of contractor against public entity for extra work and non-payment on multimillion dollar projection and successful defense of counterclaims for construction defects and fraud.
- Defense of construction manager against suit by condominium developer resulting in a defense award, including attorneys’ fees.
