Andrew P. Beilfuss / Associate
Professional Experience
Andy Beilfuss is a member of Quarles & Brady's Litigation and Corporate Services Practice Groups. His practice focuses primarily on litigation, often in the franchise and product marketing and distribution context, but he also frequently advises on contract drafting and regulatory matters including advising on product distribution, state and federal franchising laws, the Uniform Commercial Code, INCOTERMS, terms and conditions of sale and state distribution and relationship laws. Andy has experience in handling complex commercial disputes in various state courts, federal court, arbitration, mediation and administrative hearings. He has been involved in all aspects of litigation from pre-lawsuit negotiations to trial preparation, actual trial, and post-trial motions. Additionally, Andy has appellate experience in both state and federal appellate courts.

Prior to attending law school, Andy received a Master’s Degree from the University of Wisconsin – Milwaukee’s Graduate Business School and worked as a business/financial consultant for one of the nation’s leading business consulting firms. In addition to his business education and experience, Andy also has a bachelor's degree in Kinesiology.

Recent Experience Includes:

  • Litigating multiple franchise and distribution cases including matters involving claims under the Wisconsin Fair Dealership Law, the Wisconsin Franchise Investment Law, the Wisconsin Auto Dealer's Day in Court Act, as well as other state and federal relationship laws.
  • Negotiating and drafting franchise agreements, distribution contracts, warranties and terms and conditions of sale.
  • Creating and administering compliance programs for both start up franchisors and large established franchise operations including programs to ensure compliance with state and federal registration, disclosure, business opportunity and other relationship laws.
  • Advising on a wide variety of issues related to product distribution.

 

Recent Notable Litigation Results Include:

 

  • Successfully defended one of the nation’s largest franchisors against allegations of fraud, as well as violations of the Wisconsin Fair Dealership Law, the Wisconsin Franchise Investment Law and various other consumer protection laws.
  • Successfully reversed on appeal a Racine County Circuit Court decision that was adverse to the interests of one of the country's largest and oldest construction companies.
