Professional Experience
Brenda Maloney Shafer is a member of the Quarles & Brady Health Law Group in Phoenix, Arizona. Her practice focuses primarily in health law, and in particular, health care regulatory and transactional work. Along with her law degree, she holds a Masters of Law in Health Law. Ms. Maloney Shafer’s experience includes:
  • Actively participate in negotiations and draft key transactional documents for physician joint ventures.

  • Represent physicians, nurses, pharmacists and other health care providers before state licensing boards.

  • Draft and negotiate physician employment, recruitment and separation agreements.

  • Draft and negotiate medical group participation agreements with third-party payors.

  • Advise physician groups on variety of issues including medical staff bylaws, fair hearing plans, employee issues, shareholder agreements, valuation of practice, and noncompetition disputes.

  • Draft healthcare licensing opinions for real estate refinancing and sale of long term care facilities.

  • Research state board of pharmacy licensing laws and contact regulators in every state for variety of licensing and operational issues.

  • Lead healthcare team in proposed acquisition of a blood derivative product wholesaler, involving review and analysis of pharmaceutical supplier and customer contracts for FDA, state and federal licensing/registration, and fraud and abuse issues.

  • Advise in the development, licensing and operations of an aesthetic medicine training academy.

  • Review and revise clinical trial agreements for oncology research group.

  • Review and revise Medicare Part D agreements on behalf of PBM.

  • Advise pharmacies, prescription drug wholesalers and PBMs on FDA, DEA, and state regulatory issues.

  • Researched corporate practice of dentistry for all 50 states, drafted amendment to proposed legislation involving non dentist owners of dental facilities, actively participated in discussions with legislators and stakeholders to amend proposed legislation.

  • Work extensively with medical practice groups of all specialties and advise on use of and transition to EMR and practice management software.

  • Advise concierge medical practices on use of technology as value added service, i.e., access to entire medical record on thumb drive, enhanced interaction between provider and patient, and ability to obtain test results, schedule appointments and make inquiries on line.

  • Strive to provide sound legal advice in a practical manner that advances the client's business and operational needs.

Her previous work as an associate at Rodey, Dickason, Sloan, Akin & Robb, P.A. (Albuquerque, New Mexico) from August 2002-May 2005 included the following experience:

  • Represented hospital based providers in all phases of medical malpractice litigation including discovery, motions practice, depositions and trial.

  • Successfully drafted and argued multiple summary judgment motions dismissing hospital from case.

  • Represented physicians and nurses before licensing boards.

  • Draft and negotiate physician employment, recruitment and assistance agreements on behalf of not for profit hospital.

  • Regular participation on Medical Review Commission.
