Professional Experience
Dawn C. Valdivia practices in the area of labor and employment law and is the Pro Bono Coordinator for the Phoenix office. She began her career as a trial attorney at the National Labor Relations Board. She regularly advises clients regarding issues of workplace discrimination, employee discipline and termination, employer policies, and compliance with state and federal labor and employment laws. She has extensive experience representing clients before the NLRB and the Equal Employment Opportunity Commission, and in complex litigation matters. She also has experience representing employers before the Department of Labor, Industrial Commission, during union organizing campaigns, and in collective bargaining and labor arbitrations. Ms. Valdivia’s most recent experience includes:
- Successful defense of national semiconductor company in panel arbitration against claims for breach of contract, tortious interference with contract, and breach of covenant of good faith and fair dealing.
- Successful defense of a national trucking company in an unfair labor practice proceeding before the National Labor Relations Board.
- Successful defense of a national insurance company in a gender discrimination case before a jury in Federal court.
- Successful defense of international package transport company in an unfair labor practice proceeding before the National Labor Relations Board.
- Successful representation of national emergency service provider in union organizing campaign.
- Successful representation of various national and local companies in race, religion, disability, age, and gender discrimination investigations by the EEOC.
- Successful representation of national brewing company in gender discrimination lawsuit in California State Court.
- Successful defense of numerous national and local clients in labor arbitrations.
- Successful defense of company in complex discrimination case involving multiple plaintiffs, defendants, and experts.
