Jon Kammerzelt represents hospitals and other health care providers in matters spanning the full range of health care laws and regulations. A trusted partner and counselor, he focuses on:

Jon understands how to advise hospitals in a way that balances the complex legal, operational and business issues they face. Fully immersed in the hospital world and well versed in the operational details and mission of his clients, he not only answers questions but anticipates them, providing counsel on the implications of any proposed course of action and offering practical recommendations and solutions aimed at satisfying their business needs.

Jon is chair of the Health & Life Sciences Practice Group in the Madison office. He also serves as the firm's national recruiting chair.

Experience in Action

  • Advising hospitals and other health care providers on state and federal regulatory compliance issues, including those involving fraud and abuse laws (Stark and Anti-Kickback), Medicare Conditions of Participation, EMTALA and HIPAA.
  • Representing hospitals and other health care providers on mergers, acquisitions and joint ventures.
  • Advising hospitals on various operational matters involving patient care, practitioner credentialing and corrective action, HCQIA/peer review and professional practice regulation.
  • Negotiating and preparing professional service agreements and participating provider agreements with commercial insurance plans.
  • Helping hospitals prepare for and respond to surveys from regulatory and accrediting organizations, including those that could result in the termination of Medicare enrollment and/or significant financial penalties.
  • Advising hospitals and other health care providers on how to manage and respond to governmental investigations and inquiries involving false claims, Stark law and Anti-Kickback violations.
  • Advising health systems on the development, licensing and enrollment of new hospitals and the conversion of outpatient departments to provider-based status.

Successes

  • Successfully negotiated the resolution and ultimate dismissal of large False Claims Act investigation by the U.S. Attorney's Office on behalf of home health provider.
  • Worked with health system leaders to license and operationalize multiple remote location micro-hospitals.
  • Successfully guided a hospital through a large-scale government survey that placed the hospital in immediate jeopardy and threatened the hospital's Medicare enrollment.
