Professional Experience
Kasey Nye practices bankruptcy law representing large and small business and nonprofit entities as creditors and debtors in Arizona and throughout the United States. In more than a decade of practicing exclusively in bankruptcy and restructuring, Mr. Nye has worked with clients in many industries, including hospitality, real estate, banking, financial, special servicing, construction, restaurant, manufacturing, retail, franchise, nonprofit, church, and equipment leasing. He served as law clerk to the Honorable Eileen W. Hollowell, United States Bankruptcy Judge for the District of Arizona. Mr. Nye’s recent experience includes:
- Representing debtors in successful reorganization of the Westin La Paloma and Westin Hilton Head resort hotels in a heavily contested Chapter 11 proceeding. Mr. Nye led the Firm’s representation of the Debtors, including the development of the Chapter 11 Plan that attracted a $61 million new equity investment and restructured over $250 million of senior secured debt notwithstanding creditor’s § 1111(b) election. Plan also facilitated the consensual restructuring of long term management with brand on terms more favorable to ownership. Plan was confirmed objections by mezzanine and senior secured debt after evidentiary hearing.
- Representing financial institutions and special servicers regarding distressed secured loans (including loans secured by operating business assets; commercial real estate; accounts receivable; and combinations of the foregoing); including all aspects of pre-bankruptcy workouts, bankruptcy proceedings (including trials on stay relief, valuation and plan confirmation), and non-bankruptcy enforcement proceedings, and related litigation.
- Representing businesses and trustees in bankruptcy litigation including defending preference, fraudulent transfer and claim objection adversary proceedings in Arizona, Southern District of New York, Central District of California, and Delaware.
- Prosecuting and defending bankruptcy appeals to United States District Court, the 9th Circuit Bankruptcy Appellate Panel, 9th Circuit Court of Appeals, and 7th Circuit Court of Appeals.
- Representing one of the largest providers of outsourced manufacturing services in Mexico with respect to assumption, assignment, rejection, and termination of complex international service contracts and leases in Chapter 11 bankruptcies throughout the United States.
- Representing Catholic Bishop of Northern Alaska (Fairbanks Diocese) Roman Catholic Church of the Diocese of Tucson in their seccessful Chapter 11 reorganization cases.
- Representing HUD qualified general contractor in restructure and workout resulting from out of state general partner becoming insolvent including extensive work on resolving capitalization issues, intercompany debt issues, negotiations regarding separation of general partners, and workout with bonding company.

Professional and Civic Activities
Mr. Nye is active in the Volunteer Lawyer Program assisting with clinics, training law students, and representing individuals pro bono. Mr. Nye serves as president of the School Board of Saints Peter & Paul Catholic School, and on the board of Catalina Terrace Athletic Program (a 501(c)(3) organization). He also serves on the steering committee of the Pima County Legal Community Against Hunger and is active in the Democratic Party.
Mr. Nye has also obtained pro hac vice admission for cases in numerous jurisdictions across the United States.
Mr. Nye has been an adjunct faculty member at the
University of Arizona James E. Rogers College of Law teaching a bankruptcy dischargeability litigation clinic. Mr. Nye represented
Pima County on the Executive Committee of the State Bar of Arizona's Young Lawyer Division. Mr. Nye also served on the State Bar of Arizona's Mentorship Committee.
