Professional Experience
Katie Perhach practices in the Commercial Litigation Group. Her practice focuses on litigation disputes involving lender liability, bankruptcy, eminent domain and condemnation, land use, and property rights and easements. Her most recent experience includes:
- Representing financial institutions in the defense of lender liability, consumer fraud, Truth in Lending, Real Estate Settlement Procedures Act, Home Ownership and Equity Protection Act, and Fair Debt Collections Practices Act claims.
- Representing creditors in Chapter 7, Chapter 11 and Chapter 13 bankruptcy cases in bankruptcy courts across the country, seeking relief from stay to recover collateral, reviewing and advising creditors on debtor’s reorganization plans, reviewing and advising creditors on the assumption and assignment or rejection of their leases or contracts, advising creditors on their reclamation claims, pursuing non-dischargeability claims, defending breach of stay litigation and various other bankruptcy-related matters.
- Representing creditors in foreclosures, repossessions, garnishments, receiverships and other enforcement actions.
- Obtaining the dismissal of a $2.3M preference claim filed by the trustee in a paper company’s bankruptcy case against one of its suppliers (In re American Pad & Paper Co., 478 F.3d 546 (3d Cir. 2007)).
- Representing a municipality in the creation of a planned development district ordinance and in the negotiation of a development agreement for over 400 acres of property within that district.
- Representing a municipality in a Kenosha County jury trial to determine the just compensation to be awarded to the landowner in the eminent domain proceeding.
- Representing a landowner in obtaining just compensation under Wisconsin eminent domain law from the Wisconsin Department of Transportation for three times the amount offered in the initial award of damages from the Department.
- Representing a municipality in an appeal over whether a landowner was provided with a comparable replacement property under Wisconsin eminent domain law.
- Representing title companies in disputes over property rights, easements, and the validity of mortgages.
- Assisting a very large pharmaceutical distributor in responding to hundreds of subpoenas issued by various governmental entities or in various state or federal criminal or civil court proceedings, including the production of electronic information.
- Successful pro bono representation of a Senegalese citizen seeking asylum in the United States.
- Successful pro bono representation of a family member seeking guardianship over her two minor nieces after the unfortunate death of their mother.
