Kerry Mohan counsels employers on compliance with federal and state employment and labor laws regarding occupational safety and health, employee discipline, terminations, performance counseling, leaves of absences and accommodations, collective bargaining agreements, executive compensation, employee severance, and whistleblowing.
Kerry represents employers in all aspects of employment issues, including discrimination, workplace harassment, and retaliation claims under ADA, ADEA, FMLA, OSHA, NLRA, Title VII of the Civil Rights Act of 1964, other state and local statutes, and various other common law torts and employment contractual disputes. He also defends clients before the OSHA Review Commission and various state-plan agencies against willful, serious, and repeat citations. Kerry has experience defending clients against whistleblower allegations arising under federal laws, including OSHA. He also provides general compliance counseling and advice concerning OSHA inspections, investigations, and regulatory compliance.
Kerry has practiced in state and federal courts and administrative agencies in Wisconsin, Illinois, Indiana, Iowa, Michigan, Nebraska, Pennsylvania, and Ohio. He has also practiced before several alternative dispute forums, including the American Arbitration Association and the Financial Industry Regulatory Authority (FINRA).
