Lucy R. Dollens, Partner


Lucy Dollens concentrates her practice in commercial litigation. She handles all aspects of business litigation disputes, including advising clients on a broad range of contractual issues prior to the initiation of litigation. Her practice extends to federal and state trial and appellate courts, bankruptcy courts, proceedings involving governmental agencies and regulators, and class actions. Additionally, Lucy represents and advises clients on the enforcement of restrictive covenants in employment agreements and with respect to premises liability issues.

Licensed in both Indiana and West Virginia, Lucy also has extensive experience defending financial institutions, loan servicers, credit card issuers, auto finance companies and other consumer finance companies in a broad range of litigation disputes, including matters involving breach of contract, breach of fiduciary duties, lender liability, commercial and residential contested foreclosures, and consumer protection/fraud issues, just to name a few. Lucy also litigates disputes involving alleged violations of RESPA, TILA, FCRA, FDCPA, FCBA, TCPA, HOEPA, OCC Regulations and various state consumer protection statutes. She has successfully litigated collection and servicing claims; allegations of unauthorized fees, costs, and force-placed insurance; receiverships; claims regarding credit, life, and disability insurance; condemnation and easement issues; improper lien claims; allegations of invalid notes and mortgages; standing to foreclose issues, including challenges to the use of MERS; violations of stay and discharge injunctions; relief from stay to recover collateral; and adversary proceedings in bankruptcy courts. Lucy has also worked closely with financial institutions, advising on internal processes and governance matters with respect to compliance and regulatory issues.

Lucy's practice also focuses on appellate litigation, where she represents individuals and corporate clients in both state and federal appellate courts on an expansive range of legal issues including but not limited to commercial litigation, labor and employment disputes, products liability claims, premises liability matters, and administrative and licensing issues. Finally, she represents amicus curiae parties regarding significant issues of Indiana law before Indiana’s Court of Appeals and Supreme Court.
