Lucy R. Dollens, Partner

Biography

Lucy Dollens concentrates her practice in complex commercial litigation. She handles all aspects of business litigation disputes, including advising clients on a broad range of contractual issues prior to the initiation of litigation. Her practice extends to federal and state trial and appellate courts, bankruptcy courts, proceedings involving governmental agencies and regulators, and class actions.

Lucy also advises and defends financial institutions, loan servicers, credit card issuers, and a broad range of consumer finance companies regarding lender liability claims, commercial and residential contested foreclosure matters, and consumer protection/fraud issues. She litigates disputes involving alleged breaches of fiduciary duties and violations of RESPA, TILA, FCRA, FDCPA, FCBA, TCPA, HOEPA, OCC Regulations and various state consumer protection statutes. She has successfully litigated breach of contract claims; collection and servicing claims; allegations of unauthorized fees, costs, and force-placed insurance; receiverships; claims regarding credit, life, and disability insurance; condemnation and easement issues; improper lien claims; allegations of invalid notes and mortgages; standing to foreclose issues, including challenges to the use of MERS; violations of stay and discharge injunctions; relief from stay to recover collateral; and adversary proceedings in bankruptcy courts. Lucy has also worked closely with financial institutions, advising on internal processes and governance matters with respect to compliance issues.

Additionally, Lucy represents and advises financial institutions and other corporations regarding enforcement of restrictive covenants in employment contracts and premises liability claims.

Lucy's practice also focuses on appellate litigation, where she represents individuals and corporate clients in both state and federal appellate courts on a broad range of legal issues. Additionally, she represents amicus curiae parties regarding significant issues of Indiana law before Indiana’s Court of Appeals and Supreme Court.
