Professional Experience
Matthew Heinke’s practice encompasses a broad range of real estate transactions, including the representation of corporations, financial institutions, assets advisors, real estate investment funds, and governmental entities in the acquisition, disposition, financing, leasing, zoning, and development of multi-family, industrial, office and retail properties. Mr. Heinke’s practice also includes advising clients on transactional and litigation matters relating to distressed real estate assets and nonperforming loans. Mr. Heinke also has significant experience representing clients in real estate related litigation matters, including the representation of lenders and borrowers in judicial foreclosure matters, representation of landlords and tenants in eviction matters, and representation of governmental entities and landowners in eminent domain matters. Mr. Heinke’s recent experience includes:
- Representation of national life insurance company in its mortgage financing of apartment, office, industrial, and retail properties located in the state of Illinois, Wisconsin, Minnesota, Ohio, Michigan, Indiana and Missouri.
- Representation of three life insurance companies in a two-phase $480,000,000.00 mortgage financing transaction involving fourteen borrowers and 35 facilities located in 10 different states.
- Representation of lender in the sale of a portfolio of performing mortgage loans with an aggregate loan value of over $100,000,000.00 and with individual mortgages located in over 12 different states.
- Representation of borrower in a deed-in-lieu of foreclosure transaction involving a $33,000,000.00 loan secured by a large multi-tenant retail shopping center located in the Chicago suburbs.
- Representation of publicly traded real estate investment trust in its acquisition of multi-family properties and development properties located in the states of Washington and California.
- Representation of agricultural investment fund in the auction sale of over 30 agricultural properties located in the states of Illinois, Indiana, Wisconsin and Ohio with each of the 30 agricultural properties successfully closing within 30 days from the auction date.
- Representation of Chapter 11 bankruptcy trustee in its management and disposition of the bankruptcy estate's real estate assets located in the states of Illinois, Florida and Arizona.
- Representation of regional waste management service provider in obtaining a zoning text amendment and a special use permit for the construction of a truck maintenance and storage facility.
- Representation of a senior housing operator in obtaining amendments to an existing planned development to construct a 200,000 s.f. expansion to its existing senior housing community.
- Representation of lender in a highly publicized and contested judicial foreclosure action involving a historic commercial high-rise building located in downtown Chicago.
- Representation of large industrial property owner in litigation relating to the challenge of a Chicago area municipality's $45,000,000.00 special assessment tax for area infrastructure improvements.
