Michael H. Fleck, Associate

Biography

Michael Fleck practices in the firm’s Intellectual Property Practice Group focusing on patent litigation, prosecution, and counseling. Michael has engaged in many aspects of litigation including pleadings, motions to dismiss, preliminary injunction proceedings, Markman briefing, fact discovery, expert discovery, summary judgment motions, and pre-trial motions and filings. Michael has also practiced before the United States Patent and Trademark Office’s Patent Trial and Appeal Board.  

In addition, Michael has significant patent prosecution and counseling experience and regularly advises clients in matters related to patent infringement, patent validity, patentability, and patent portfolio management. His experience includes:

  • Drafting over 90 utility patent applications and dozens of design patent applications; 
  • Prosecuting domestic and foreign patent applications through issuance; 
  • Drafting non-infringement, freedom-to-operate, and invalidity opinions; 
  • Conducting due diligence investigations for product releases and corporate acquisitions; and
  • Advising in-house counsel and corporate officers on drafting and prosecution strategies.
