Carelessness or a lack of understanding as to what and how much information contractors expect sinks many ADRs responses.
When Alyce Katayama, a partner with law firm Quarles & Brady in Milwaukee, works on ADR responses, “I do conference calls, I ask questions, I ask for more documentation and I try to assemble the strongest possible case,” says Katayama. “It’s almost like filing a brief in court. You have to treat it as if the outcome depends on how well you put the package together, because it does.”
