John L. Barlament, a partner at Quarles & Brady with experience in privacy and security issues, said companies have an interest in following the report’s recommendations.

If companies do so voluntarily, Congress or the FTC will be less likely to impose stricter regulations or obligations on them, Barlament said.

“The FTC wants to encourage innovation and is worried about regulating too stringently in this area,” he added. “But it also wants companies to ‘play fair’ and offer consumers some privacy and security protections.”
