Hing's attorney, Steven Hirsch, argued Scottsdale's desire for Hing's property conflicts with a consultant's study commissioned by the city last summer. The study included recommendations for new station locations but did not identify the area immediately around Indian Bend and Hayden roads, Hirsch said.
"The city arbitrarily and capriciously ignored that report and instead sited this station on Mr. Hing's property 1.3 miles away from where their expert said it should go," Hirsch said.
