Professional Experience
Peter Tomasi practices in the areas of environmental permitting and environmental litigation. Mr. Tomasi has further experience with general civil, commercial, and intellectual property litigation. His recent experience includes:
- Representation of multiple clients in citizen suits brought under the Clean Air Act and Clean Water Act.
- Representation of a utility relating to several challenges to a proposed generating facility, including challenges to the preconstruction permit issued under the New Source Review provisions of the Clean Air Act and discharge permit issued by the state NPDES permitting program.
- Assisted with defense of challenges to the adequacy of the application for a wetlands permit under Chapter 30 of the Wisconsin Statutes, and with challenges to an application for a wetlands dredging permit required by Section 404 of the Clean Water Act.
- Representation of multiple clients in challenges to the adequacy of environmental assessments and environmental impact statements prepared in accordance with the Wisconsin Environmental Policy Act (WEPA).
- Assisted numerous clients in obtaining required New Source Review, Title V, FESOP, Chapter 30, and WPDES permits.
- Experience with the various requirements of state and federal regulations governing utilities.
- Assisting a Fortune 500 transportation company in developing its first carbon management and climate change strategy.
- Providing due diligence to the lender underwriting the construction of a 133 turbine, 200 MW wind farm in Wisconsin, which also included an evaluation of the need for and completeness of efforts to obtain relevant federal, state and local approvals.
- Assisting a utility in identifying necessary regulatory approvals relating to the conversion of an existing 40 MW coal fired power plant to combust 100 percent biomass, and providing advice relating to obtaining an air pollution control permit for that facility.
- Advising a $40 million nameplate ethanol plant and a $110 million nameplate ethanol plant in Wisconsin regarding air and wastewater permitting matters.
- Advising clients regarding environmental and regulatory concerns relating to the construction and operation of renewable energy projects including biomass, solar and wind energy.
