Health Care: Pharmaceuticals

Quarles & Brady is recognized as one of the premier pharmacy law groups in the country. In addition to representing clients before all 50 State Boards of Pharmacy, we are experienced in all areas of law that impact pharmacy clients, including FDA/regulatory, Health Care: IP, Health Care: Mergers and Acquisitions. Our group members are nationally known as pharmacy law experts and have given pharmacy law presentations to national pharmacy trade groups. These leadership roles and speaking engagements not only enhance our stature in the industry, they also provide our attorneys with excellent national contacts and credibility.

We have represented clients before all 50 State Boards of Pharmacy on matters including licensing, compliance and disciplinary matters. As outside counsel for mail order, retail, supermarket, hospital central processing, central fill, automated, Internet, compounding pharmacies, wholesalers and pharmacy benefit managers, we regularly analyze and summarize the pharmacy laws in each jurisdiction in order to advise our clients on appropriate practice. Our attorneys’ broad understanding of these laws — and how they differ from state to state — helps our group provide practical legal advice.

We regularly assist clients in understanding how these varying state laws apply to the practice of pharmacy and have been very successful in helping our clients obtain regulatory approval for new technology or processes that are not contemplated in the current law. For example, we have obtained approval for automated dispensing technology, electronic medical records, electronic prescribing, virtual pharmacy systems, central fill and central processing pharmacies, pharmacy call centers, remote order entry sites and new drug delivery systems.

We also assist our pharmacy clients by inspecting and auditing their facilities to provide guidance on how to improve processes and assure compliance with applicable law. In addition, our attorneys have helped clients involved in restructuring, mergers, sales or acquisitions to ensure that their pharmacies are appropriately licensed.
