Professional Experience
Tom McCarthy's practice encompasses a broad range of real estate transactions, including representation of borrowers and lenders in connection with financing secured by real estate, sales and acquisitions of commercial real estate, including office, industrial, and multifamily properties. Tom has also represented a variety of clients in all types of real estate transactions, including landlords and tenants of office buildings and retail shopping developments, residential real estate developers, and municipal corporations. Tom's recent experience includes:
  • Representing a Chicago area community bank in handling all matters related to the disposition of REO assets, including providing bank financing to purchasers acquiring the REO assets.

  • Representing a regional bank in connection with mortgage loans for multi-family, industrial, and mixed-use properties in Chicago and surrounding areas for loans ranging from $4 million to $25 million.

  • Representation of a county forest preserve district as land acquisition counsel, handling over 50 separate acquisitions totaling more than 2,550 acres, and negotiating and preparing intergovernmental agreements, easements and licenses, and advising regarding riparian rights and obligations for properties owned and managed by the forest preserve district.

  • Representation of the ownership of 500 W. Madison Street in Chicago, Illinois in connection with its retail and office leasing at the building.

  • Representation of a publicly traded REIT, assisting in over 45 acquisitions of multifamily housing properties nationwide with a combined purchase price of over $1 billion dollars for properties located throughout the United States, including properties in Arizona, California, Colorado, Florida, Georgia, New York, Virginia and Washington.

  • Representation of a national lender in connection with preparing and documenting commercial real estate loans and financing agreements for loans totaling over $900 million dollars, which loans were secured by properties located throughout the Midwest, including Illinois, Missouri, Indiana, Wisconsin, Michigan and Ohio.

  • Representation of developers and construction lenders to advise regarding provisions under the Illinois Condominium Act, including requirements for condominium declarations and amendments thereto, procedures for developing add-on condominiums, and developer liability and association turnover requirements.

  • Representation of a not-for-profit charity in the sale of a prominent and historically significant and landmarked property located in Chicago's Gold Coast neighborhood.

  • Representation of a national lender in connection with new construction loans for major condominium projects located in the City of Chicago, including negotiation of loan documents and intercreditor agreements with mezzanine and subordinated lenders.

  • Representation of a real estate fund, assisting in the acquisition, annexation, zoning and entitlement of over 2,000 acres located throughout the metropolitan Chicago area and the subsequent sale of the finished lots to local and national home builders.
