Managing materials in your products and in the waste your facilities produce in compliance with local, state, federal and international requirements and practices — that's our objective in advising clients regarding materials management and recycling. From the myriad of e-waste initiatives and regulations issued at the state and country level to the product component prohibitions under laws like the EU and China RoHS standards, we help you not only understand the requirements and purposes of these various laws and initiatives, we also help you development management programs incorporating QA/QC, product testing, waste analyses and handling protocols, and supply chain relationships for managing your compliance obligations and goals with your bottom line in mind.

When materials have been historically managed on-site, our clients rely upon our expertise in brownfields redevelopment, beneficial reuse applications, recycling and the requirements of the Resource Conservation and Recovery Act (RCRA) and its state counterparts. We have assisted manufacturers, municipalities, lenders and investors in understanding how to navigate the regulatory requirements applicable to waste and by-product materials, be it in the context of land redevelopment, materials characterization and disposal, mergers and acquisitions or financing.

Representative Engagements / Experience:

  • Advising management of a supply chain regarding compliance for product component restrictions under state, federal (e.g., TSCA) and international (e.g., EU RoHS) laws.

  • Successfully litigating air permit challenges to the largest coal transshipment facility in North America and to the first coal-fired electric generating station built in Wisconsin in the past two decades.

  • Our practice group chair, Arthur A. (Tony) Vogel, Jr., chaired the Wisconsin Governor's Blue Ribbon Task Force on Waste Materials Recovery and Disposal (2005–2008), which was commissioned to develop policy options and recommendations to ensure environmental protection and economic growth when dealing with waste reduction, recycling, reuse and disposal issues in Wisconsin.
