Representative Transactions

  • When a satellite television operator launched an antitrust lawsuit against participants in the Arizona cable industry, we successfully defended a national cable programmer named in the action.
  • We defended the manufacturer of several brand-name prescription drugs in a statewide consumer class action alleging an antitrust conspiracy among national drug manufacturers to prevent the discounting of drug prices or offers of rebates to retail pharmacies.
  • We represented a consumer products company in an arbitration seeking to enforce a noncompetition covenant entered into as part of our client's multimillion-dollar acquisition of a business that sells a nationally known household product. At issue was whether the seller breached the covenant by selling a product with attributes similar to the product line sold to our client. After several days of witness testimony presented to the arbitration panel, the case settled.
  • When the lightning protection system manufactured by a member of a building industry standards-setting organization failed to gain approval, we defended against allegations that the organization and its other members had engaged in a conspiracy to prevent this approval. We ultimately entered into a favorable settlement.
