Quarles & Brady won an affirmance on a matter of first impression at the Court of Appeals, defending an arbitrator’s award of summary judgment in favor of a developer against a builder’s claims for breach of contract and fraudulent concealment. After the plaintiff builder unsuccessfully sought reconsideration of the order granting summary judgment, Quarles & Brady applied to confirm that award with the trial court. Having received the confirmation sought, Quarles & Brady then defended it at the Court of Appeals, winning an affirmance establishing that, given the parties’ arbitration agreement and the Arbitration Association’s rules adopted by the agreement, the arbitrator had authority to grant summary judgment in the client’s favor.
