Daniel Griffith assists clients across the lifecycle of trademark asset development and implementation, including work on prosecution, enforcement, portfolio maintenance, and Opposition and Cancellation proceedings. He has assisted clients in industries such as beer, food and beverage, consumer packaged goods (CPG), technology, entertainment (music), cannabis, manufacturing, electronics, software development, and retail.
Working with both domestic and international trademark portfolios, Daniel handles new mark clearance and selection strategies, and counsels clients on trademark rights acquisition and development. Additionally, he manages trademark prosecution of applications before the United States Patent and Trademark Office (USPTO), with experience responding to and overcoming non-substantive and substantive refusals, Ex Parte appellate work, and related prosecution issues.
Daniel has experience negotiating and securing positive outcomes in various trademark disputes to obtain favorable settlements and has secured coexistence / consent agreements in connection with TTAB and U.S. District Court actions, in pre-litigation contexts, and as a response to substantive Section 2(d) refusals to register.
