Tax-Exempt Employer’s Legal Spring Cleaning: Tidying up your Independent Contractor, Joint Employment and Documentation Issues

Chicago Office

Program Overview: In an effort to operate as efficiently as possible, TEOs are constantly exploring staffing by consultants or contractors, rather than employees. However, not every contractor is independent and your consultants may really be your employees. In this session we will revisit the legal definitions of contractors and employees, and the very real risks/costs for misclassifying employees as contractors. We will also discuss the joint employment relationship between TEOs and PEOs, and what you should be doing to protect yourself from employment liability when engaging PEOs. In the second half of the session, we will identify and try to help you correct the very common, and often very expensive, problems that all employers face in employment-related documentation (including performance, discipline, PIPs, and internal email).
