Kerry M. Mohan, Of Counsel


Kerry Mohan is a member of the Labor & Employment group. His practice focuses on counseling employers on compliance on a wide-variety of federal and state employment and labor issues regarding occupational safety and health, corporate transactions, employee discipline, terminations and reductions in force, performance counseling, employment litigation, leaves of absences and accommodations, collective bargaining agreements, union organizing, executive compensation, employee severance, and whistleblowing.

Kerry has represented employers in diverse industries in all aspects of employment issues, including discrimination, workplace harassment, and retaliation claims under the ADA, the ADEA, the FMLA, OSHA, the NLRA, Title VII of the Civil Rights Act of 1964, other state and local statutes, and various other common law torts and employment contractual disputes. Kerry also has wide experience defending clients against whistleblower allegations arising under federal and state laws.

Kerry has extensive experience counseling and advising employers on safety and health-related materials under the Occupational Safety and Health Act. He regularly defends employers in OSHA matters before the OSHA Review Commission and state-plan agencies, and has defended employers after catastrophic events and incidents involving employee fatalities.

Kerry has also conducted multiple sensitive and executive-level internal investigations regarding purported misconduct and whistleblowing, and prepared investigative reports for board of directors and other C-Suite officers.

Kerry also advises companies and boards of directors on the full spectrum of labor and employment issues involved in the sale, acquisition, merger, or other forms of corporate transactions. As part of these services, Kerry has represented both buyers and sellers on issues involving executive retention, separation, and employment agreements.
