Fred Gants, a partner in the Madison, Wisconsin, office of Quarles & Brady, says the takeaway from this case is clear: do not retaliate, ever. “This case is a very logical extension of the Supreme Court decision in Thompson. The broad consensus is that retaliation claims take many forms and courts are permitting them to move forward against employers. As a result, if employers want to stay out of court, they should be careful not to retaliate in the first place.”
