James Goldschmidt and Nathan Oesch Secure Summary Judgment Win in Seventh Circuit

Law360 recently featured a win in favor of our client, Miller Compressing Co., in the Seventh Circuit Court of Appeals. In an antitrust suit involving the enforcement of towing rules and competition for vehicle processing services in Milwaukee, James Goldschmidt and Nathan Oesch convinced the appellate panel to uphold the district court’s dismissal with prejudice of all claims against Miller Compressing.

The plaintiffs initially claimed that our client’s contract with the City of Milwaukee for the processing of abandoned vehicles violates the Sherman Act in a way that didn’t require a rule of reason analysis but was per se unlawful. The panel upheld the lower court and said the contract did not constitute bid-rigging or horizontal price fixing, concluding the plaintiff had not adequately pleaded any violation of the Sherman Act.
