The whole affair may seem tacky at first glance, but the university must have had strong motivation to take on the potential criticism and risk to its reputation, according to some legal observers. University leaders may have been driven by pressure to bring in revenue even in unconventional ways, says Stephen J. Gardner, JD, partner in the Intellectual Property Practice Group with the law firm of Quarles & Brady.

“Universities are under more pressure now to bring in more income, create jobs, and have more of an economic impact in their community. Some states have economic programs that impose some obligations on universities to be drivers of economic development, and the tech transfer office’s reply is usually ‘easier said than done,’” Gardner says.
