The Patent Trial and Appeal Board has ruled that a CaptionCall LLC patent covering closed-captioned error-correction technology used by the hearing impaired was invalid, a win for Ultratec Inc. which also recently won $44 million from a federal jury after it determined that CaptionCall infringed several Ultratec patents.

In a final written decision in an inter partes review under the America Invents Act requested by Ultratec, the PTAB found Thursday that CaptionCall's U.S. Patent No. 8,379,801 is unpatentable as obvious in light of prior art.

In its IPR petition, Ultratec had challenged claims 1-29 of the '801 patent — which generally relates to correcting errors within a text caption system used to facilitate hearing-impaired communication, according to the ruling.
