8:35 to 9:35 a.m. - Legal Ethics in Insurance Recovery

Presented by: Patrick J. Murphy; Natalie Pedregal Thomas; and Lexi Russello, Senior Assistant General Counsel, Marsh & McLennan Agency LLC

A host of ethical issues routinely arise in insurance coverage disputes. If they are not expressly addressed in a timely manner, these issues may prevent policyholders from maximizing their insurance recovery and prejudice the defense of claims against the policyholder. The focus of this presentation will be on simple questions, the answers to which are sometimes surprisingly complicated when there are disputes regarding the existence and scope of insurance coverage for an underlying claim, including, but not limited to:

  • Who is the client?
  • Which conflicts trigger the right to independent counsel?
  • Does the insured get to select its independent counsel?
  • Does a privilege apply to communications shared with the insurer?
  • What communications can the insured withhold from its insurer on privilege grounds?

10:45 to 11:45 a.m. - Ethics Issues for Lawyer Members of Nonprofit Boards

Presented by: Norah L. Jones; Jodi P. Patt; and Chelsey Ziegler, Associate General Counsel, MacArthur Foundation

A review of ethical considerations for lawyers serving on nonprofit boards, including a discussion of: 1) fiduciary obligations; 2) how to spot and address conflicts of interest; and 3) potential legal malpractice concerns.


Who Should Attend?
This seminar is designed for in-house counsel and other interested corporate executives. We will provide a form and apply for 3.0 hours (60-minute states) and 3.5 hours (50-minute states) of ethics continuing legal education credit in all requested states.

A certificate of attendance will be issued via email upon program approval. Please note this is a live program only; there is no webinar component.
