Session 1

Title: Start Right: The University’s Role in Effectively Fostering New Faculty Startups and Managing Associated Risks
Date: Thursday, July 29, 2021

Overview: Universities often play a significant role in fostering startups, providing support both in terms of resources and guidance. The interactions between universities and startups can be mutually rewarding, but can also present a series of unique considerations and risks. Universities have to consider a wide range of issues, including creating and enforcing policies that: appropriately define the relationship between the university, the startup, and their (often overlapping) employees; manage expectations of faculty, students, and entrepreneurs; delineate appropriate use of university resources; and properly characterize ownership of intellectual property. This session touched on the challenges faced by universities, highlighted some of the common issues that can arise, and outlined best practices to minimize the surprises that a university may face when collaborating with startups.

Session 2

Title: Patent Coverage and License Scope: How and When They Need to Align

Overview: Historically, license agreements have been upheld in some circumstances where the royalty obligation did not align exactly with the substantive and territorial reach of the licensed patents. A recent case law has examined the enforceability of licenses, and suggested even further expansion of the royalty obligation may be possible. We explored the history of enforceability of royalty obligation, a comparison to patent misuse, and discussed the recent case law.

Title: Artificial Intelligence: IP Strategies for Technology Transfer

Overview: Artificial intelligence (AI) and machine learning are at the forefront of academic research across multiple and interdisciplinary fields of technology. This webinar summarized the intellectual property (IP) rights and other legal issues surrounding AI technologies. In-depth practical examples were provided as a framework for triaging new invention disclosures and developing commercialization strategies for academic technology transfer.

Title: Artificial Intelligence: Data Licensing, Usage & Privacy Considerations

Overview: Organizations are already using technologies that incorporate AI and machine learning functionalities, but these technologies are not always recognized as such by the organizations licensing those technologies. In this presentation, we discussed real world considerations to reduce risk when developing, implementing and using AI technologies. We addressed key contractual provisions, data privacy and usage rights, IP infringement and product liability concerns related to developing and licensing of AI technologies.
