Heather Buchta, a Quarles & Brady partner in the Intellectual Property Practice Group and co-chair of the firm’s Data Privacy & Security team, was quoted in a Bloomberg Government article about the various ways companies could be impacted by state laws governing health data privacy.

With many states adopting or considering laws to protect the health data of consumers, a wide array of companies need to understand how these laws impact them. An excerpt:

States are increasingly concerned about the use of health information collected by period-tracking apps, online companies, and other businesses that don’t fall under privacy provisions of the federal law.

Broad data definitions in health privacy legislation “encompass a lot more than you would potentially think,” Heather Buchta, partner at Quarles & Brady LLP, said in an interview. The Washington and Virginia laws allow individuals to sue over violations, which increases business risks.

“Those are kind of the ones that are sticking out to us more and causing a little more concern,” Buchta said.
