Jeffrey Wolf of Quarles & Brady gave a pre­sentation on litigating trademark issues in franchise matters. "I am going to talk about doom and gloom, or potential gloom and doom," he began. "What happens when a client sells or operates an illegal franchise?" 

He said there is a "parade of horribles" of potential actions that can be taken - federal enforcement, state enforcement and private actions. 

"Violations of the FTC Rule may result in a federal enforcement action, which may include a lawsuit brought in federal district court under Section 5 of the Federal Trade Commission Act," Wolf said.
