Notably, employers need to think about complying with both the law and their company policy, since a policy may go beyond what the law requires or vice versa, said Ted Hollis, a partner with management-side firm Quarles & Brady LLP."

Then you've got to be concerned about the fact that there are a minority of states, just a few, California, Montana and Nebraska, that prohibit by law forfeiture of unused PTO upon separation," he said. "So, even if your policy says that it's forfeited for employees in those states, that's not enforceable, and you will have to pay out the time."

Different jurisdictions also impose different deadlines for the timing of final payment of wages.

"They're all deadlines you have to be mindful of, especially if you're a multi-jurisdictional employer," Hollis said.
