Ben Nielsen is an experienced litigator, trial lawyer and appellate advocate representing clients in complex commercial and civil matters and appeals in Arizona and nationwide. He has successfully represented individuals and businesses in litigation matters across a variety of industries. The time Ben spent in-house working for a large public university helps him better understand, represent and efficiently resolve problems for institutional clients. Ben focuses on:

Ben is the pro bono partner for the firm's Phoenix office and serves as chair of the Phoenix Summer Associate Committee.

Experience in Action

  • Representing financial services institutions and mortgage companies, including in lien disputes, quiet title actions, tax lien foreclosures, excess proceeds litigation, noncompete and nonsolicitation issues, defense of consumer complaints involving FCRA, FDCPA, TCPA, TILA, and state law claims, and so on.
  • Representing businesses in corporate and commercial disputes, including contract disputes, defense and assertion of claims related to officers and directors, shareholder and LLC member disputes, commercial torts, nonsolicitation and noncompete agreements, creditor claims and insurance claims.
  • Representing direct sales companies, including in all stages of litigation and in connection with governmental investigations.
  • Representing higher education institutions, including in areas of government regulation; administrative, disciplinary and Title IX hearings; assisting with open meetings and public records laws and issues; and all stages of litigation.
  • Advising on real estate disputes, including title claims, contract disputes, real estate professional claims, commission disputes, construction matters, lien claims, lease enforcement and defense, and administrative claims.
  • Defending and prosecuting professional liability claims and select personal and financial injury matters.
