About Elizabeth

Experienced advisor on Medicare and Medicaid programs

Elizabeth Gebarski advises clients on health care regulatory and compliance issues, business development, government program enrollment issues and licensing issues. Her experience includes:

  • Health care transactions
  • Medicare and Medicaid program compliance from the provider and plan perspective, including Medicare and Medicaid notification and filing requirements
  • Pharmaceutical industry matters, including Federal and State permit and licensure issues and DEA Requirements for controlled substance distribution and prescription dispensing

Elizabeth takes a holistic approach, providing legal strategy within the client’s broader business context. She highlights the implications a decision will have on their business and, instead of simply answering the question asked, she understands the "why" and suggests alternatives that will resolve the underlying issue.

Experience in Action

  • Advises on health care transactions for providers and suppliers of all types, including pharmacies, durable medical equipment, prosthetics, orthotics and supplies (DMEPOS) suppliers, behavioral health practices and hospitals.
  • Counsels clients on compliances issues from both the provider and plan perspective, including non-resident Medicaid fee-for-service enrollment restrictions (i.e., brick and mortar states).
  • Works with pharmacy clients such as retail, mail order, specialty, compounding, front- and back-end pharmacies, 503B outsourcing facilities, wholesalers and DME/HME providers.

Successes

  • Strategized method and manner of a deal with a keen eye to change of ownership (CHOW) reporting requirements and reimbursement gaps that impacted thousands of Medicare and Medicaid enrollments across the U.S. The team completed the required filings to many of the fee-for-service programs.
  • Won appeals to CMS revocation decisions for Medicare DMEPOS suppliers.
  • Led Medicare, Medicaid, NPI and NCPDP filings related to acquisition of multiple national pharmacies licensed in all U.S. states and Washington, D.C., with hundreds of enrollments, including in California (Medi-Cal) and Florida.
