“Health Care Employers Should Start to Implement Strategies for ACA Reporting, Attorney Says”

Time is of the essence for employers determining filing strategies now that the IRS has released final filing forms for tax code Section 4980H involving employer-shared responsibility provisions under the Affordable Care Act, a benefits attorney said.

And where strategies are concerned, there is a lot to track, said John L. Barlament, a partner at Quarles & Brady LLP in Milwaukee.

“Look at a spreadsheet of all the information you need to track and verify who has it: do you have it, does a broker have it, TPA, multiemployer plan?” he said. “You still need to move ahead, verify communications issues, who is going to take the phone calls, verify that control group status—that can take a fair amount of time.”

He spoke during a International Foundation of Employee Benefit Plans webcast on March 17.
