Patent litigation in the US can be expensive and time consuming. According to an American Intellectual Property Law Association Economic Survey, the average cost of a patent infringement suit with damages between $1m and $25m is $1.4m through the end of discovery and $2.6m through trial. Managing litigation costs is often critical to a successful outcome – no matter how that is defined. Whether you are the plaintiff or defendant, the following practices can be implemented to manage patent litigation costs.
