Title: Patent Coverage and License Scope: How and When They Need to Align

Overview: Historically, license agreements have been upheld in some circumstances where the royalty obligation did not align exactly with the substantive and territorial reach of the licensed patents. A recent case law has examined the enforceability of licenses, and suggested even further expansion of the royalty obligation may be possible. We will explore the history of enforceability of royalty obligation, a comparison to patent misuse, and discuss the recent case law.

Title: Artificial Intelligence: Data Licensing, Usage & Privacy Considerations

Overview: Organizations are already using technologies that incorporate AI and machine learning functionalities, but these technologies are not always recognized as such by the organizations licensing those technologies. In this presentation, we will discuss real world considerations to reduce risk when developing, implementing and using AI technologies. We will address key contractual provisions, data privacy and usage rights, IP infringement and product liability concerns related to developing and licensing of AI technologies.
