The Federal Circuit revived a $5.4 million verdict against a manufacturer of captioned phones that a Wisconsin federal jury found infringed the asserted claims of a patent covering the devices, holding Friday that a judge erred in tossing the jury’s determination that the patent was valid.
The appellate court panel determined that because accused infringers Sorenson Communications Inc. and CaptionCall LLC failed to present sufficient evidence to establish that it would have been obvious for an ordinarily skilled artisan to have used a combination of prior art to craft the invention, U.S. District Judge James D. Peterson erred by overturning the jury’s upholding of the patent held by Ultratec Inc. and CapTel Inc., according to its opinion.
