Edward King Poor of Quarles & Brady LLP brought Union Pacific’s arguments before a three-judge panel of the appellate court Monday, asking that the court overturn a lower court ruling enforcing an EEOC subpoena against the freight hauling company.

“Unlike other federal agencies, the EEOC’s authority to investigate is not unlimited,” Poor told the court before being hit with a barrage of questions about the limit of that authority.
