“This may signal that the administration does not intend to ‘rock the boat,’ at least in the short term, even if 340B oversight ultimately moves under CMS’ purview. Nonetheless, it’s certainly plausible that areas of focus during audits may change per CMS directives to its contracted auditors,” he said in an email.

French added that “although removed from the final proposal, the previous leaked version seemed to signal that CMS ultimately desires to increase oversight over 340Bsavings utilization—thus, it’s possible that CMS would prioritize implementing federal340B covered entity reporting requirements similar to those currently in place in several states.”
