Alabama Board of Pharmacy Removes Affidavit Requirement for New Wholesaler Applicants

At its October 2025 board meeting, the Alabama Board of Pharmacy (the “Board”) voted to remove a requirement that new wholesale distributor applicants sign an affidavit affirming that products distributed in Alabama will only be purchased from Alabama-licensed manufacturers.

This affidavit requirement was implemented in response to Ala. Code § 34-23-32(g) which states that:

No manufacturer, manufacturer affiliate, bottler, packager, repackager, third party logistic provider, wholesale drug distributor, private label distributor, outsourcing facility, or pharmacy business identified in the supply chain of any legend drug or device shall ship, or caused to be shipped, into the state any legend drug or device without a valid permit issued by the board.

As licensed entities, wholesale distributors are already required to comply with applicate federal, state, and municipal pharmacy laws. As such, wholesale distributors must provide a file, during initial application, at renewal and upon request, with their trading partners’ names and Alabama license numbers.

Last November, the Board voted to remove a similar requirement for wholesaler renewal applications because not all manufacturers were permitted in Alabama at the time of renewal. Instead of requiring wholesalers to provide the Alabama license number for every trading partner, the Board allowed licensing staff to continue to process renewal applications and contacted manufacturers directly regarding licensure requirements.

Now that the affidavit requirement has been removed for all initial and renewal applications, applicants can expect any pending applications to move forward with review.
