Jaya White and Kiel Zillmer Write McKnight's Home Care Article on What DME Moratorium Means for Medical Supply Companies
Jaya White and Kiel Zillmer, both Quarles & Brady Health & Life Sciences attorneys, authored an article for McKnight’s Home Care discussing the Centers for Medicare & Medicaid Services’ (CMS) decision to implement a six‑month pause on new Medicare enrollments for certain medical supply companies due to fraud concerns. While most existing suppliers are unaffected, new or re‑enrolling suppliers may face additional restrictions.
An excerpt:
Entities seeking new enrollment under the pharmacy category should ensure that the supplier type designated on their CMS-855S form is consistent with their principal function, that they are appropriately licensed under state law, and that all CMS submissions and internal documentation reflect this category. In addition to closely scrutinizing all DMEPOS supplier applications submitted during the moratorium, CMS may research applicants’ online information and conduct site visits of such businesses.

Given the severity of the moratorium’s effects, and its impact on the home infusion industry, it is imperative that DMEPOS suppliers currently enrolled in the Medicare program remain vigilant about maintaining their enrollment in good standing by submitting information updates within 30 days, completing revalidations on time, and responding promptly to requests from Medicare Administrative Contractors.
