Quarles & Brady attorneys Matt Drenan and Pouch Liang wrote an article for the Daily Journal about the key points employers need to understand related to California's new Workplace Know Your Rights Act. Drenan, a partner, and Liang, an associate, are San Diego-based members of the firm’s Labor & Employment Practice Group.
In the article, they note what the act requires of employers, how it will be enforced, applicable penalties if an employer is caught in violation of the act and next steps employers should take to ensure compliance.
An excerpt:
Employers in California have new workplace rights notice requirements under California's Workplace Know Your Rights Act ("Know Your Rights Act") following amendments to the California Labor Code imposed by Senate Bill 294 ("SB 294"). The legislative intent is clear: The Legislature desires California Workers to have "a strong understanding of their rights as workers, as well as their constitutional rights." (SB 294, section 1551(a).) To achieve this goal, the Know Your Rights Act incorporates several prior requirements with new obligations into one stand-alone notice that California employers must provide their employees.

Compliance is a team effort and California employers should provide training to their managers, supervisors and human resources personnel on the necessary requirements so that the process goes as smoothly as possible.
