Successes

  • Represented pharmacy associations in suing the state Medicaid agency for failure to pay pharmacies appropriate reimbursement rate under federal law. Successfully persuaded the federal government to reverse its prior approval of the reimbursement rate after federal litigation action.
  • Assisted a nonresident pharmacy client in obtaining full permit approval following a state's refusal to grant a renewal. After filing a lawsuit and motion for emergency injunctive relief, the state granted full licenses promptly after reviewing the client's briefing on claims, including violations of state administrative law, due process and the Dormant Commerce Clause.
