We always take a calm, considered approach to potential litigation and during emergency or crisis situations, we move quickly to help shape your response. As the regulatory landscape changes, we’ll help you stay proactive and prepared, so you’re ready to comply with new mandates and avoid missteps.

Attorneys with deep knowledge of the health care industry

Health care entities across the full spectrum of the industry have sought our help to resolve complex disputes and difficult regulatory compliance and enforcement issues. We represent hospitals, pharmacies, PBMs, wholesalers, manufacturers, long-term care providers, physicians and many other health care providers across the country. We understand the world of health care: Our team includes lawyers who have served in government at various levels and others who have trained and are licensed as pharmacists, nurses and physical and occupational therapists. On behalf of health care clients, we have handled litigation related to licensing, discipline, fraud, waste and abuse, reimbursement, medical staff privileges, exclusive contracting with hospital-based physicians, antitrust, certificate of need, rate setting, charity care, contract disputes and construction, to name a few.

  • Governmental investigations involving the U.S. DOJ, DEA and other state and federal agencies
  • Fraud, waste and abuse
  • HIPAA and data breach investigations and subpoenas
  • Pharmaceutical and medical device manufacturers involved in commercial and tort litigation
  • Professional liability and licensing proceedings for health providers
  • Medicaid and Medicare reimbursement
  • Constitutional challenges of state laws affecting health care providers
  • General business litigation for health care clients, including class action, contract matters, managed care and medical staff disputes, and intellectual property disputes

  • Represented pharmacy associations in suing the state Medicaid agency for failure to pay pharmacies appropriate reimbursement rate under federal law. Successfully persuaded the federal government to reverse its prior approval of the reimbursement rate after federal litigation action.
  • Assisted a nonresident pharmacy client in obtaining full permit approval following a state's refusal to grant a renewal. After filing a lawsuit and motion for emergency injunctive relief, the state granted full licenses promptly after reviewing the client's briefing on claims, including violations of state administrative law, due process and the Dormant Commerce Clause.
