Dedicated labor and employment counsel
Tyler Roth advises employers on a broad range of labor and employment issues. As an experienced defense counsel, he has handled all aspects of litigation, including discovery management, taking and defending depositions, mediation and settlement negotiations, briefing and arguing dispositive motions, and trial.
Tyler is actively involved in the firm’s pro bono efforts, including as co-chair of the Children’s Hospital of Wisconsin Guardianship Clinic.
Experience in Action
- Litigates and obtains favorable judgments on various types of employment cases, including claims of wrongful termination, discrimination, harassment and retaliation before state and federal courts and government agencies, including the Equal Employment Opportunity Commission (EEOC), the Department of Workforce Development (DWD), Wisconsin Equal Rights Division (ERD), and state and federal courts.
- Defends class actions alleging unpaid wage and overtime violations under the Fair Labor Standards Act and state wage payment laws.
- Advises on all aspects of the employment relationship, including employment agreements, grievances, employee discipline and termination, discrimination, harassment and retaliation, disability and leave issues, wage and hour compliance, employment policies and other personnel matters.
- Counsels on labor-management relations, including arbitrations, union organizing and elections, and unfair labor practice proceedings before the National Labor Relations Board (NLRB).
- Assists with unemployment compensation and independent contractor disputes before the Wisconsin Labor and Industry Review Commission (LIRC).
- Advises on federal contractor requirements, affirmative action plans and jurisdictional challenges before the Office of Federal Contract Compliance Programs (OFCCP).
- Provides insight on employee leave and reasonable accommodations, disciplinary decision-making, employment policies and procedures, and handbook reviews.
- Conducts independent workplace investigations, customized trainings and presentations.
