Susan Brichler Trujillo works with clients across the pharmaceutical drug and device distribution chain, helping manufacturers, distributors and health care providers operate successfully within their highly regulated industry. With clients including retail pharmacies, pharmacy wholesalers, durable medical equipment (DME) providers, pharmaceutical distributors, pharmacy benefit managers, hospitals, behavioral health providers, residential care providers and licensed professionals, Susan advises on:

  • Administrative law matters

Maintaining open lines of communication and good relationships with regulators throughout the United States, and always cognizant of a client’s risk tolerance and business goals, Susan delivers solutions for her clients that minimize risk and make the most of market opportunities.

Susan is chair of the Phoenix office Health & Life Sciences Practice Group.

Experience in Action

  • Advising providers and distributors on permit, licensure and regulatory matters, including pharmacies, DME providers, manufacturers, wholesale distributors and third-party logistics providers (3PL).
  • Working to accelerate licensure of facilities needed to manufacture and distribute drugs, devices and other medical products needed for COVID-19 and other urgent business matters, including representing industry trade groups and pharmacy supply chain participants with state regulators.
  • Advising on medical discount card regulation and contracting.
  • Counseling on U.S. Drug Enforcement Administration (DEA) requirements for controlled substance distribution and prescription dispensing.
  • Advising on national regulation of pharmaceutical providers, including pharmacies, outsourcing facilities, pharmaceutical and device manufacturers, DME suppliers and pharmaceutical distributors.
  • Advising on the regulatory aspects of health care mergers and acquisitions, including change of ownership (CHOW) and regulatory requirements.

Successes

  • Successfully achieved multiple dismissals of regulatory complaints before multiple Boards of Pharmacy across the country.
  • Obtained rapid issuance of distribution permits to allow third-party logistics providers to assist with distribution of medical devices during COVID.
